In MF v NF & Ors [2026] EWFC 243, handed down on 8 September 2026, Mr Justice MacDonald in the Family Court considered the scope of the power to strike out a statement of case under rule 4.4(1) of the Family Procedure Rules 2010 and of the court's wider case management powers under rule 4.1. The appeal also raised the role of pleadings in a dispute between a spouse and a third party over the ownership of property in financial remedy proceedings. Counsel could not identify a reported case in which pleadings in such a claim had been struck out under rule 4.4(1). The appeal was heard on 22 and 23 July 2026. The judgment uses the initials MF (the wife), NF (the husband), AF and KN.
Background
The parties married in 2015 and have two children. The wife issued her divorce application in July 2023. In his Form E the husband said he was the legal owner of a property but had no beneficial interest because he had gifted it to AF in 2018. He also said he owed a trust £5.77M in loans.
The wife disputed the husband's account of the gift, of the ownership of Y Ltd and its sale proceeds, of the assets held in the trust, and of the loans. She contended that the matrimonial assets were about £7.23M. The husband said they were in deficit by about £2.16M.
The wife's Points of Claim alleged that the 2018 Declaration of Trust was a sham, alternatively that the husband had disposed of the property to defeat her claims on divorce, and that the Y Ltd proceeds and the trust loans were resources available to him. AF and KN were joined as parties in August 2025. The husband, AF and KN each argued that the claims were inadequately pleaded and applied to strike them out.
The decision under appeal
On 31 March 2026, District Judge Ashworth struck out the wife's Points of Claim on both the property and the Y Ltd proceeds, and removed KN as a party. The application was dealt with on submissions, with no evidence heard and no findings of fact. The judge held that the wife's Points of Claim did not provide a factual basis for her assertions. She rejected the wife's argument that the principle in Wyatt v Vince [2015] UKSC 14, under which a substantive financial remedy claim cannot be struck out under rule 4.4(1), applies to individual issues. In the alternative, she relied on her case management powers.
Permission to appeal was granted on all grounds on 6 May 2026. The appeal was heard at High Court level because it raises an important point of principle or practice.
What this means for people in financial remedy proceedings
The appeal concerns how far a court can bring a property ownership dispute to an early end through strike-out and case management powers when a third party is involved. The judgment sets out the court's reasoning and conclusion on those questions. Anyone involved in such a dispute should read the judgment and get legal advice before any court deadline passes.
